End User License Agreement (EULA)
Acceptance of Terms
By installing, accessing, or using the AYA Pay digital wallet application by AYA Bank, you agree to the terms and conditions of this EULA. If you do not agree to these terms, you must cease using the App and uninstall it. Your continued use signifies your agreement to these terms, as well as any future updates or modifications.
License Grant
The app provider grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal and lawful purposes. This license does not allow you to:
- Modify, alter, or reverse engineer the app.
- Distribute or share the app with others.
- Use the app for commercial purposes without written permission from the provider.
All rights not expressly granted are reserved by the app provider.
User Responsibilities
As a user, you agree to the following:
- Account Security: You are responsible for safeguarding your account credentials, including usernames, passwords, and personal identification numbers (PINs). Any unauthorized access or use of your account must be immediately reported.
- Compliance with Laws: You agree not to use the app for any illegal or fraudulent activities, including money laundering, terrorism financing, or unauthorized fund transfers.
- Accuracy of Information: You must ensure that all information provided during account setup, such as your identity, contact details, and financial information, is accurate and up to date. Misrepresentation may result in account suspension.
Fees and Payments
- Transaction Fees: Some services within the app, such as transfers or bill payments, may incur fees. A full schedule of fees is provided within the app or on the official website. The provider reserves the right to modify these fees, and users will be notified in advance.
- Billing and Refunds: All fees are billed at the time of the transaction. Refunds for services or failed transactions are subject to the app provider’s refund policy, which can be accessed via customer support.
- Third-Party Fees: The app provider is not responsible for any fees charged by your bank, mobile carrier, or other third parties in connection with the use of the app.
Transaction Limits
- Daily Limits: The app may impose limits on the amount of money that can be transferred or withdrawn within a day. These limits are set to prevent fraud and ensure compliance with local financial regulations.
- Verification: Users may need to undergo additional identity verification to access higher transaction limits or certain features. The provider may request additional documentation such as government-issued identification.
Privacy and Data Collection
- Personal Data: By using the app, you agree to the collection and use of your personal information as outlined in the app’s Privacy Policy. The data collected includes, but is not limited to, your name, contact details, transaction history, and location.
- Usage of Data: The provider may use your data to:
- Process transactions and manage your account.
- Improve app features and security.
- Send promotional offers (you can opt-out of marketing communications).
- Share information with third-party service providers (e.g., for fraud detection) or as required by law.
- Security: While the provider employs industry-standard security measures to protect user data, you acknowledge that no system is completely secure. The provider is not liable for data breaches unless caused by gross negligence.
Limitation of Liability
The app provider will not be liable for:
- Any direct, indirect, incidental, or consequential damages arising from the use of the app.
- Losses resulting from unauthorized access to your account, unless such access is due to the app provider’s negligence.
- Interruptions in service or technical issues beyond the provider’s control (e.g., downtime or server outages).
- Issues with third-party services or apps connected to your digital wallet account.
Dispute Resolution and Governing Law
- Dispute Resolution: In the event of a dispute regarding your use of the app, you agree to first attempt to resolve the issue through the app provider’s customer service channels. If the dispute cannot be resolved, it will be subject to arbitration, governed by the laws of [Jurisdiction], without regard to its conflict of laws principles.

Termination of Service
- By the User: You may terminate this agreement at any time by ceasing to use the app and uninstalling it from your device. Any outstanding balances or unresolved transactions must still be completed.

Modifications to the EULA
The app provider reserves the right to update or modify this EULA at any time. You will be notified of any significant changes via the app or email. Continued use of the app after the changes take effect constitutes acceptance of the new terms.
